telkom wins court case 20 June 2008
Telkom has won a Pretoria High Court bid to stop the Competition Commission from referring a dispute to the Competition Tribunal, ITWeb reported on Friday. The dispute is with the South African Value Added Service Providers, who charged that Telkom abused its market dominance by refusing to supply them with its facilities unless they met Telkom's conditions. The complaint against Telkom was lodged in 2004.
Telkom argued in court, among other things, that the Competition Tribunal had no competence to rule on the matter. The fixed-line operator said the service providers' complaint should rather fall in the jurisdiction of the Independent Communications' Authority of South Africa (Icasa).
The court did not give the reasons for its ruling in favour of Telkom.
