      Lufuno Mphaphuli and Associates ( Pty) Ltd v Andrews and Another 2009 (6) BCLR 527 (CC) The Supreme Court of Appeal, in dealing with an appeal against a High Court’s judgment dismissing an application for the review and setting aside of an award made by an arbitrator in a private arbitration, observed that a private arbitration process was not an administrative process which had to be lawful, reasonable and procedurally fair.
      The Minister of Energy made regulations regarding the use of payment cards to purchase petroleum products at retail sites under section 2 of the Petroleum Products Act, Act 120 of 1977. A payment card includes a debit, credit and cheque card. The regulations were published in the Government Gazette on 9 July 2009. To view the regulations click here...

      Here today, gone tomorrow: Withdrawal of VAT rulings Unlike other taxes, the VAT Act made provision for Sars to issue rulings which were binding on it. However, in order to incorporate the advanced tax ruling regime which had been introduced into the Income Tax Act in October 2006, and to streamline the application process for obtaining binding VAT rulings, the VAT Act was amended so that binding rulings had to be applied for in terms of the newly introduced section 41A or 41B of the VAT Act. An important issue which had to be dealt with flowing from these changes was the status of all the rulings which had been issued prior to 1 January 2007 and more particularly, the issue of whether such rulings could be relied on in respect of transactions entered into on or after 1 January 2007.
